Brazil Considers Controversial ‘Fake News’ Bill, Tech Giants Express Concerns

Brazil’s Congress is currently deliberating on a regulatory bill, known as Bill 2630 or the Fake News Law, that has raised concerns and sparked a dispute between President Luiz Inacio Lula da Silva’s administration and major tech companies like Google. The proposed legislation would hold internet companies accountable for reporting illegal content on their platforms, resembling the European Union’s Digital Services Act.

Google recently faced pressure to remove a link from its Brazil homepage opposing Bill 2630, claiming the legislation could lead to public confusion and urging users to voice their opposition to the bill. The bill itself aims to penalize tech companies that do not address fake news and illicit content on their platforms, making it one of the strictest regulations for social media and content-hosting websites.

Tech giants, including Google and Facebook, have voiced concerns that the proposed legislation might be susceptible to misuse for censorship and could impact the availability of free content services. The bill has undergone changes in recent weeks, leading to a lack of awareness about its contents, according to Google.

Justice Minister Flavio Dino strongly criticized Google for attempting to stifle debate, demanding the removal of the link within two hours or face significant fines. Google complied promptly, removing the link within minutes. Justice Minister Dino applauded the move on Twitter, emphasizing the importance of the law prevailing over the digital landscape.

In response to concerns raised by major tech companies, Supreme Court Justice Alexandre de Moraes issued an order requiring leaders of Google, Meta, Spotify, and Brasil Paralelo to testify to federal police regarding potential misinformation about the bill. The debate surrounding the bill occurs amid ongoing challenges in Brazil, including unfounded claims about the electoral system and concerns about the influence of social media on public safety.

The fate of Bill 2630 remains uncertain due to resistance from conservative and Evangelical lawmakers who align with big tech firms against the government and its allies. Representative Orlando Silva, an author of the bill, emphasized its role in protecting against misinformation impacting Brazilian politics and contributing to violence in schools.

This legislative debate follows a recent Brazilian appeals court decision lifting a suspension against the messaging service Telegram, which faced accusations of non-compliance with requests for information about extremists and neo-Nazis on the platform. While the suspension was lifted, the court upheld a fine against Telegram for failing to fulfill the information request.
