The administration’s recent announcement regarding the removal of exemptions from tariffs on “bifacial,” or two-sided, solar panels marks a significant shift in U.S. trade policy within the solar industry. These panels, which constitute a substantial portion of solar imports, will now be subject to a 14.25 percent duty, as indicated by the White House.

Addressing reporters on Wednesday, White House climate adviser Ali Zaidi emphasized concerns over unfair trade practices abroad, stating, “The investment boom that we’re seeing in the United States is threatened by unfair and non-market practices taking place overseas.” This move comes amidst ongoing challenges faced by the solar sector, including inflationary pressures and disruptions stemming from the COVID-19 pandemic.

While the Solar Energy Industries Association had previously supported the reinstatement of exemptions on bifacial modules during the Trump administration, many domestic solar manufacturers have long advocated for tariffs to counteract the influx of inexpensive imports, particularly from Southeast Asian countries where Chinese firms operate to evade existing U.S. fees.

The Biden administration’s decision to revoke these exemptions could have broader implications, potentially influencing the upcoming presidential race and impacting solar manufacturing, particularly in crucial swing states. This decision aligns with former President Donald Trump’s stance on trade tariffs, who has consistently advocated for tougher measures while criticizing what he perceives as Biden’s leniency towards China.

According to statements from the White House, the imposition of tariffs on Southeast Asian imports aims to address concerns regarding circumvention of antidumping and countervailing duties on Chinese solar manufacturers. By implementing these measures, the administration seeks to create a more level playing field for domestic producers and mitigate the adverse effects of unfair trade practices.

In addition to removing exemptions, the administration has pledged to adjust the U.S. tariff-rate quota for imported solar cells as necessary. This adjustment is intended to ensure a steady and sufficient supply of solar cells for domestic panel manufacturers, thereby supporting the growth of U.S. manufacturing capacity within the renewable energy sector.

Furthermore, the administration announced a significant allocation of $70 million in grants for domestic solar producers under the bipartisan infrastructure law. These funds, to be distributed by the Department of Energy to 18 selected projects, are aimed at strengthening the domestic solar supply chain and fostering innovation within the industry.

The White House has also issued new guidance concerning the domestic content adder, a 10 percent tax credit bonus for clean energy projects utilizing a significant proportion of American-made products. The updated guidance simplifies the process for determining project eligibility, allowing developers to utilize Department of Energy-provided default cost percentages.

These recent tariff announcements represent a broader strategy by the Biden administration to limit imports of clean energy products, particularly those with ties to China. Concurrently, the International Trade Commission and Commerce Department have initiated investigations into alleged illegal trade practices by Chinese companies operating in Southeast Asian countries.

Prompted by a petition filed by a coalition of seven solar manufacturers, including industry leaders like Hanwha Qcells and First Solar, these investigations aim to assess the impact of subsidized solar imports from Malaysia, Cambodia, Thailand, and Vietnam on U.S. solar manufacturers. The preliminary assessment by the ITC is expected in early June, with Commerce’s determination anticipated in early October.

While Southeast Asia has accounted for a significant portion of U.S. solar panel imports in recent quarters, there are divergent views within the solar manufacturing industry regarding the potential ramifications of a stricter tariff regime. Leslie Chang, director of strategy and policy at Caelux, emphasized the importance of considering the short-term implications on energy deployment and urged investment in domestic manufacturing capacity to ensure a competitive marketplace.
