Several Fintech Companies Under Regulatory Scrutiny for KYC Lapses

The Reserve Bank of India (RBI) is reportedly looking into several fintech companies over potential lapses in their Know-Your-Customer (KYC) processes, according to sources familiar with the matter. These companies, which include a prominent payments aggregator and wallet service provider, are facing scrutiny as part of a broader review of KYC practices in the financial sector.

Sources indicate that some fintech firms, particularly those in the unsecured loan marketplace and acting as intermediaries between customers and lenders, are also being investigated for similar concerns. These developments come at a time when India’s financial institutions are undergoing an audit by the Financial Action Task Force (FATF), which evaluates global efforts to combat money laundering and terrorism financing.

In a notable case, Paytm Payments Bank was subjected to strict restrictions on January 31 after the RBI found issues with its KYC compliance. According to sources, at least four additional payment companies are currently under review for similar issues.

Regulatory perspectives suggest that KYC systems implemented by fintech firms are perceived to be less robust than those of traditional banks. This is part of a broader effort by Indian authorities to ensure stronger verification systems are in place, aligning with international standards set by FATF.

India’s Finance Ministry has reportedly engaged with industry stakeholders on KYC and fraud prevention, including addressing concerns regarding mule accounts, which are used for illicit money laundering activities.

FATF’s review of India, which had been delayed due to the COVID-19 pandemic, is expected to conclude in mid-2024. The organization’s assessment will evaluate the country’s preparedness to prevent financial crimes and its compliance with global standards. Non-compliance could result in financial sanctions that could hinder foreign investment.

The Enforcement Directorate, along with other financial regulators, is also involved in investigating and monitoring money laundering activities in the fintech sector.
