Florida Governor Expected to Sign Truck-Towing Reforms into Law

Florida Governor Ron DeSantis is expected to sign legislation aimed at reforming truck-towing practices in the state, a source familiar with the reforms disclosed. The bill, known as House Bill 179, has garnered bipartisan support and is anticipated to become law effective July 1st.

The proposed reforms, which have been in the works for several years, aim to address issues of predatory billing against truckers requiring towing services. Sponsored by both Republican members of the Florida House and Senate, the bill has been met with unanimous approval in both chambers. Notably, the Florida Trucking Association has championed these efforts, considering them a significant victory for the trucking industry in the state and nationally.

Key provisions of the legislation include:

  • Regulations on towing and storage rates, with counties required to establish maximum rates for certain services.
  • Measures to exclude or penalize non-designated wrecker operators.
  • Authorization of fees, with requirements for transparent invoicing and detailed rate sheets.
  • Mandates for towing operators to maintain and provide rate sheets upon request, ensuring transparency for vehicle owners, lienholders, and insurance companies.

The bill also introduces criminal penalties for noncompliance, aiming to deter predatory tactics within the towing industry.

Alix Miller, President and CEO of the Florida Trucking Association, hailed the legislation as a crucial step towards curbing predatory towing practices. Emphasizing the importance of collaboration with towing and recovery operators, Miller expressed gratitude for their input in shaping the reforms, highlighting the potential to enhance safety and fairness within the industry.

Findings from a report by the American Transportation Research Institute, released in November, underscored the prevalence of predatory towing fees following truck crashes. The study identified excessive rates and unwarranted additional charges as common issues faced by motor carriers, prompting recommendations for regulatory intervention.

If signed into law by Governor DeSantis, these reforms are poised to bring significant changes to the towing industry in Florida, fostering transparency and accountability for the benefit of truckers and the motoring public alike.
