The European Union (EU) has taken steps to uphold restrictive measures under the EU non-proliferation regime regarding Iran. The decision to maintain these restrictions beyond the JCPoA Transition Day, which was originally scheduled for October 18, 2023, has been made due to valid reasons, as assessed by the Council.
This decision aligns with the provisions of UN Security Council Resolution 2231 and the Joint Comprehensive Plan of Action (JCPoA) in light of Iran’s failure to fulfill its commitments under the JCPoA. This lack of compliance has been reported by the International Atomic Energy Agency (IAEA) since 2019.
To ensure the continuation of these measures, the Council has adopted legal acts to keep designations in place for individuals and entities linked to nuclear or ballistic missile activities or affiliated with the Islamic Revolutionary Guard Corps (IRGC), as originally imposed by the United Nations. Additionally, sectoral and individual measures under the EU’s sanctions regime, particularly those related to Iran’s nuclear proliferation, as well as arms and missile embargoes, will be maintained.
It’s important to note that these actions should not be interpreted as the imposition of additional EU sanctions on Iran. Furthermore, any EU sanctions that had previously been lifted as part of the JCPoA will remain lifted.
This decision underscores the EU’s commitment to the full implementation of the JCPoA, as previously expressed in Council conclusions in December 2022. It also follows a letter received on September 14, 2023, by the High Representative, who serves as the Coordinator of the Joint Commission of the JCPoA. The letter was sent by the Foreign Ministers of France, Germany, and the United Kingdom within the context of the JCPoA’s Dispute Resolution Mechanism, which they activated in January 2020. In their communication, the ministers indicated their readiness to reverse this decision should Iran fully comply with its JCPoA commitments.
