European Authorities Strengthen Anti-Money Laundering Controls Through International Protocols and Domestic Reform

in Anti-Money Laundering (AML)

Summary

  • EU signs Warsaw Convention protocol to enhance cross-border asset freezing and recovery.
  • Spain eliminates small business AML exemptions and enforces strict crypto ATM rules.
  • US extends Cyprus defense relief following active anti-money laundering cooperation.

Governments and regulatory bodies across Europe are executing major structural updates to strengthen financial transparency, combat trade-based money laundering, and enhance international asset recovery. According to official statements from the European Commission and reports by News Europa and EU Agenda, the European Union formally signed the Additional Protocol to the Council of Europe Convention on Laundering, Search, Seizure and Confiscation of the Proceeds from Crime and on the Financing of Terrorism—commonly known as the Warsaw Convention—on October 14, 2026.

The new protocol establishes modernized, harmonized standards for cross-border freezing and confiscation measures, dynamic asset management, and expanded police and judicial cooperation. Designed to streamline preventive anti-money laundering measures across Council of Europe Member States, the treaty aims to dismantle illicit financial networks and accelerate the cross-border recovery of criminal assets.

At the national level, European member states are aggressively tightening domestic compliance standards ahead of international evaluations. In Spain, law firm Uría Menéndez reports alongside Veredum Legal, Focus Gaming News, and CryptoImpuestos that the government approved Royal Decree 813/2026 on October 15, 2026, following its publication in the Official State Gazette on October 8. The decree amends Spain’s underlying anti-money laundering framework under Law 10/2010 by completely removing compliance exemptions for small businesses. Under the new rule, all covered entities—regardless of organizational size or revenue—must formally designate an official compliance representative before SEPBLAC, Spain’s financial intelligence unit.

Additionally, Royal Decree 813/2026 introduces strict identity verification mandates for crypto-asset automated teller machines (ATMs) with a zero monetary threshold, closing previously exploited anonymous cash-to-crypto channels. To curb sophisticated trade and financial laundering operations, the regulations further mandate payment method ownership checks for interactive service accounts as Spain prepares for its upcoming Financial Action Task Force (FATF) Mutual Evaluation.

Meanwhile, regional AML compliance efforts are yielding diplomatic and trade dividends elsewhere in Europe. According to Global Trade & Sanctions Law, Steptoe, and the U.S. Department of State, the State Department’s Directorate of Defense Trade Controls (DDTC) published a final rule extending the suspension of proscribed destination status for the Republic of Cyprus under ITAR § 126.1 through fiscal year 2027. The annual extension follows statutory certification that Cyprus maintains active cooperation with U.S. authorities on anti-money laundering reforms and continues enforcing port access denials against Russian military vessels.
