UAW Advocates for Adjustment of Tariffs on Vehicles and Auto Parts Amid USMCA Concerns

The United Auto Workers (UAW) has recently voiced concerns regarding the existing tariff rates applied to passenger cars and parts, raising pertinent issues related to compliance with the United States-Mexico-Canada Agreement (USMCA). The current tariff structure, as outlined under the USMCA, entails a 25 percent tariff on light trucks and a 2.5 percent tariff on imported passenger vehicles and parts originating from countries designated with most-favored status. However, the UAW contends that these tariff levels may not be stringent enough to ensure full adherence to the agreement’s rules of origin, potentially opening avenues for circumvention by Chinese entities seeking entry into the U.S. auto market through Mexico.

During discussions with officials from the Office of the U.S. Trade Representative and the Interagency Committee on Trade in Automotive Goods, Jason Wade, top administrative assistant to UAW President Shawn Fain, underscored the necessity for more robust consequences for noncompliance with the USMCA. Wade emphasized that the current 2.5 percent tariff rate might not sufficiently incentivize adherence to the agreement’s provisions, thus necessitating a reevaluation of tariff policies to foster greater alignment with trade agreement objectives. Wade’s assertions come at a pivotal juncture as the trade office conducts an ongoing review of the USMCA. This review process encompasses an assessment of rules of origin enforcement mechanisms, particularly in light of technological advancements and shifts in industry dynamics such as the proliferation of electric vehicles.

In its submission to U.S. Trade Representative Katherine Tai, the UAW articulated dissatisfaction with the prevailing tariff rate, contending that it falls short in addressing trade imbalances and fails to align with prevailing global standards. While vehicles imported from China face a notably higher tariff rate of 27.5 percent, the UAW cautions against complacency, warning that the comparatively lower tariff on vehicles from countries with most-favored status could inadvertently incentivize foreign investment in Mexico’s auto sector, particularly from Chinese entities seeking to circumvent higher tariffs.

Matt Blunt, president of the American Automotive Policy Council, representing major automakers including Ford Motor Co., General Motors, and Stellantis, expressed confidence in the efficacy of the USMCA but acknowledged lingering concerns within the industry pertaining to dispute settlement mechanisms and interpretations of the agreement’s rules.

While the UAW’s advocacy underscores its commitment to bolstering enforcement mechanisms under the USMCA, industry stakeholders remain vigilant, closely monitoring developments and awaiting the Biden administration’s response to ongoing trade disputes within the North American automotive sector.
