Shein, a Chinese fast-fashion retailer, is currently facing a lawsuit in the United States, with allegations of repeated copyright infringement. The lawsuit, filed by three fashion designers, accuses Shein of violating the Racketeer Influenced and Corrupt Organizations Act (RICO), a law initially designed to tackle organized crime.
The lawsuit alleges that Shein’s business practices, involving the production of up to 6,000 new items daily, include a pattern of copying designs from other creators. This pattern is described as a “long and continuous pattern of racketeering.” The designers claim that Shein’s corporate structure facilitates these infringements and that the RICO statutes are an appropriate legal tool to address this issue.
Shein has been under scrutiny for several reasons. Earlier this year, a bipartisan group of US lawmakers raised concerns about Shein’s potential initial public offering (IPO). They requested that the Securities and Exchange Commission (SEC) review Shein’s compliance with labor laws, particularly regarding the use of forced labor from China’s Uighur population.
The current lawsuit, filed in the US District Court for the Central District of California, seeks unspecified damages and injunctive relief to prevent further alleged racketeering activities by Shein. The designers’ complaint focuses on Shein’s products featuring “exact copies of copyrightable graphic design.”
Shein has not publicly responded to the lawsuit as of the latest reports and has not confirmed any plans for an IPO this year. However, there have been indications that the company might be preparing for a listing in the US.
In response to concerns about its supply chain, Shein spokesperson Peter Pernot-Day stated that the company is committed to transparency and has a strict policy against forced labor. This commitment was reiterated following a Congressional report criticizing Shein and another Chinese retailer, Temu, for potential compliance issues with US anti-forced labor laws. Shein maintains that it adheres to customs and import laws in the countries where it operates and has a “zero tolerance” policy for forced labor.
