National Security Raids in China Raise Concerns Among Foreign Companies

Foreign businesses in China are expressing heightened concern following a series of national security raids targeting consultancy firms. The raids have underscored the challenges of conducting business in the era of Chinese leader Xi Jinping, prompting calls for clearer guidelines from authorities. Eric Zheng, president of the American Chamber of Commerce, emphasized the importance of due diligence firms in business operations and urged Chinese authorities to delineate areas where such activities are permissible, providing foreign companies with more confidence.

The concerns stem from recent legislation expanding China’s espionage laws, increasing uncertainties for businesses. The EU Ambassador to China, Jorge Toledo Albinana, noted that this legislative development is not conducive to further opening the Chinese economy. The EU Chamber of Commerce highlighted mixed signals from Beijing’s crackdowns, which coincide with efforts to restore business confidence following the shift away from the “zero COVID” strategy.

Chinese authorities recently launched an investigation into Capvision, accusing the consulting firm of sharing state secrets with overseas entities. This follows earlier actions against US consulting giant Bain & Company and the Beijing office of New York-based due diligence firm Mintz Group. The lack of transparency around these probes has generated anxiety within the foreign business community, leading to uncertainty and potential impacts on confidence.

The amendments to China’s anti-spying law, effective from July, have already created concerns, limiting foreign businesses’ access to corporate registries. Nick Marro, a global trade and China analyst, emphasized that the lack of clarity around these investigations undermines efforts to restore confidence. The uncertainty has sparked anxiety throughout the foreign business community, and the focus on American companies comes amid strained US-China relations.

Premier Li Qiang had previously indicated a favorable environment for international companies to operate in China after pandemic-related curbs were lifted. However, the recent developments raise questions about the speed and shape of China’s recovery and the regulatory environment for private industry. Despite the challenges, China’s economy is on track to meet growth targets, with authorities stating that the national security actions aim to ensure the sound development of the industry and safeguard national security interests.

The heightened tensions and uncertainties surrounding foreign businesses operating in China reflect the broader geopolitical competition between the US and China, impacting bilateral relations. A survey by the American Chamber of Commerce revealed widespread pessimism about bilateral relations, even as respondents expressed optimism about China’s economic recovery. The concerns extend beyond the national security raids to encompass broader uncertainties in China’s regulatory landscape and recovery trajectory.
