India is actively pursuing an amendment to end the long-standing freeze on the taxation of electronic trade, a significant move that could potentially allow tariffs to be imposed on a wide array of digital products, including software downloads and video games. According to a source familiar with the matter, who preferred anonymity due to the confidential nature of the discussions, New Delhi is planning to raise the issue at the upcoming World Trade Organization (WTO) ministerial meeting scheduled for February in Abu Dhabi. During this meeting, India intends to request WTO members to lift the moratorium on customs duties concerning electronic transmissions.

Since 1998, the WTO has upheld a moratorium on customs duties related to electronic transmissions, with members renewing the measure every two years. However, India, along with other developing nations such as South Africa, argues that this restriction has led to a loss of tariff revenue and has negatively impacted their trade competitiveness. The Indian government aims to introduce taxation on goods integrated into digital trade, according to the same source. Furthermore, it intends to advocate for enhanced clarity regarding the definition of goods in e-commerce.

While India pushes for the removal of the moratorium, global businesses have expressed opposition to such measures. They urge WTO members to maintain the existing restrictions, citing the importance of these measures in facilitating the industry’s recovery post-pandemic and in safeguarding global supply chains. The potential revision of the WTO’s tariff freeze on digital goods trade has sparked debates and discussions among stakeholders across various sectors. It raises questions about the future trajectory of global trade policies and the evolving landscape of e-commerce regulation.

As the discussions unfold, both proponents and opponents of the proposed amendment are closely monitoring developments within the WTO. The outcome of these deliberations could have far-reaching implications for the digital economy and international trade relations.
