The much-debated EU-Mercosur free trade agreement appears unlikely to reach a conclusion before the upcoming EU elections in June, according to insights from French and German lawmakers familiar with the ongoing negotiations.

Negotiations on the long-awaited free trade agreement between the European Union and Mercosur countries (Brazil, Argentina, Uruguay, and Paraguay) suffered another setback in early February. Contentious issues surrounding reciprocity in environmental and social standards persist, with France advocating for ‘mirror clauses’ to ensure alignment between Mercosur countries and EU environmental commitments.

With the European elections looming, the failure of recent negotiations raises doubts about the agreement’s prospects. Nils Schmid, a German MP and foreign affairs spokesman for the Socialist Group in the Bundestag (SPD), acknowledged the diminishing likelihood of concluding negotiations before the elections. Similarly, Pascal Lecamp, an MP from the Mouvement démocrate (Modem), emphasized France’s reluctance to rush into an agreement without adequate safeguards.

The protracted negotiations, spanning over two decades since their initiation in 1999, aimed to establish the world’s largest free trade area, encompassing over 780 million people and a trade volume of €120 billion annually. While negotiators reached an agreement in 2019, France’s reservations regarding Brazil’s environmental and social commitments under then-President Jair Bolsonaro led to a stalemate.

Despite renewed optimism with the return of Brazil’s current socialist president, Lula, discussions remain deadlocked over the inclusion of ‘mirror clauses.’ The European Commission’s proposal for an additional protocol containing social and environmental clauses failed to garner consensus, further complicating negotiations. Although talks resumed following the recent impasse, the Commission’s assessment indicates that conditions for concluding negotiations remain unmet. The positions of EU member states vary, with France, Austria, the Netherlands, and Belgium expressing reservations, while Spain advocates for mirror clauses.

Discontent with the sluggish pace of negotiations is palpable among some German lawmakers. SPD MP Schmid lamented the lost time and expressed disappointment with Germany’s slow progress, despite Chancellor Olaf Scholz’s commitment to revitalizing international trade policy. As the EU-Mercosur agreement remains in limbo, European priorities shift towards pressing issues such as immigration, artificial intelligence, and agricultural policies. The resurgence of agricultural concerns following widespread farmers’ protests further complicates the political landscape.

Looking ahead, lawmakers anticipate navigating through the election phase and addressing agricultural concerns before revisiting negotiations, underscoring the uncertainties surrounding the future of the EU-Mercosur trade agreement. Given the complexity of the issues at hand and the divergent interests among EU member states, reaching a consensus on the EU-Mercosur agreement remains a daunting task. The outcome of the upcoming EU elections and subsequent political developments will likely shape the trajectory of future negotiations, highlighting the need for continued dialogue and cooperation to overcome existing challenges and pave the way for a mutually beneficial trade agreement.
