Global Regulatory Initiatives Address the Challenges of Advancing Artificial Intelligence

Artificial intelligence (AI) technology, including innovations like Microsoft-backed OpenAI’s ChatGPT, continues to progress, governments worldwide are navigating the complex landscape of AI regulation. Here is a snapshot of the latest regulatory steps taken by various nations and international bodies:

Australia: The government is actively seeking input from Australia’s primary science advisory body to shape regulations governing AI. Consultations are ongoing to determine the appropriate next steps.

Britain: The Financial Conduct Authority, among several regulators tasked with formulating AI guidelines, is collaborating with institutions like the Alan Turing Institute to enhance its understanding of AI. The competition regulator is also examining the impact of AI on consumers, businesses, and the economy, considering the need for new controls.

China: China’s cyberspace regulator has introduced draft measures to manage generative AI services, requiring companies to submit security assessments before launching offerings to the public. Beijing aims to support leading enterprises in developing AI models that can rival technologies like ChatGPT.

European Union: Key EU lawmakers have agreed on stricter draft rules to regulate generative AI, proposing a ban on facial surveillance. The European Parliament is set to vote on the draft of the EU’s AI Act next month. The European Data Protection Board has formed a task force to address concerns related to ChatGPT.

France: France’s privacy watchdog, CNIL, is investigating complaints about ChatGPT following temporary bans in Italy over privacy rule concerns. France’s National Assembly approved the use of AI video surveillance during the 2024 Paris Olympics, despite civil rights groups’ warnings.

G7: Group of Seven (G7) leaders acknowledged the need for AI governance during their meeting in Hiroshima, Japan. They have initiated the “Hiroshima AI process” and plan to discuss the technology further with results expected by the end of 2023. G7 digital ministers have advocated for “risk-based” regulation on AI.

Ireland: Ireland’s data protection chief emphasizes the need for regulating generative AI but urges thoughtful considerations before rushing into prohibitions that may lack durability.

Italy: Italy’s data protection authority, Garante, plans to review AI platforms and hire AI experts after ChatGPT’s temporary ban in March.

Spain: Spain’s data protection agency is conducting a preliminary investigation into potential data breaches by ChatGPT and has sought the EU’s privacy watchdog’s evaluation of privacy concerns.

United States: The US Federal Trade Commission is committed to using existing laws to manage AI risks. Senator Michael Bennet introduced a bill to create a task force focused on AI policies and threats to privacy, civil liberties, and due process. The Biden administration seeks public comments on potential accountability measures for AI systems, emphasizing the importance of addressing societal, national security, and economic risks.

AI regulations evolve globally, governments are navigating the challenges posed by rapidly advancing technologies to strike a balance between innovation and safeguarding societal interests.
