US Department of Commerce Initiates Countervailing Duties on Shrimp Imports from India, Ecuador, and Vietnam

In a move that could have significant implications for the global shrimp trade, the US Department of Commerce (DOC) has announced plans to impose preliminary countervailing duties (CVD) on shrimp imports from India, Ecuador, and Vietnam. These countries, which are among the largest suppliers of shrimp to the United States, will face varying duty rates ranging from under 2 per cent to a maximum of 196 per cent.

The decision by the DOC follows an extensive investigation into suspected subsidy programs in these countries that allegedly allow exporters to offer shrimp at lower prices in the US market, potentially harming domestic producers. As a result of the investigation, India is set to face an overall countervailing duty rate of 4.36 per cent, with specific rates ranging from 3.89 per cent to 4.72 per cent for individual exporters. Similarly, Ecuador will be subject to a countervailing duty of 7.55 per cent on all shrimp exports to the US, with varying rates for specific companies. Vietnam, on the other hand, will see duty rates ranging from 2.84 per cent for most exporters to a staggering 196.4 per cent for Thong Thuan Company, based on adverse facts available.

The imposition of these tariffs could have far-reaching consequences for exporters and importers alike. Once officially announced in the Federal Register, importers will be required to place cash deposits equal to the determined rates with US Customs and Border Protection for up to four months. This could pose a significant financial burden for businesses involved in the shrimp trade between these countries and the US. While importers may ultimately receive refunds if the investigating authorities determine that the subsidies are not unlawful or do not harm the US shrimp industry, a final decision on the matter is not expected until late 2024. This uncertainty could result in importers facing costs for the majority of the year, impacting their bottom line and disrupting their operations.

It is worth noting that Indonesia, another significant shrimp supplier to the US, was found to have subsidy rates below the threshold requiring countervailing duties, according to the DOC. This exemption underscores the complexities involved in determining the impact of subsidies on international trade and highlights the need for a thorough and transparent investigative process. The imposition of countervailing duties on shrimp imports from India, Ecuador, and Vietnam comes at a time when the global shrimp industry is already facing various challenges, including supply chain disruptions and changing consumer preferences. In 2023, India, Ecuador, Indonesia, and Vietnam collectively accounted for 90 per cent of the total shrimp import volume into the US, valued at US$5.6 billion.
