A group of Republican members of the United States House of Representatives has requested more stringent sanctions and legal actions against Chinese technology firms Huawei and Semiconductor Manufacturing International Corporation (SMIC). This call for action comes in response to these companies’ development of an advanced smartphone, which the lawmakers argue indicates a breach of US export controls.
The letter, signed by 10 Republicans including House Foreign Affairs Committee Chairman Michael McCaul, proposes several measures. These include implementing “full blocking sanctions” against Huawei and SMIC and pursuing criminal charges against their executives. The letter also suggests revoking all current export licenses granted to these companies.
Expressing concern over the efficacy of the Bureau of Industry and Security’s (BIS) export control rules, the lawmakers criticized the continued licensing to companies like SMIC, which they allege is controlled by the Chinese Communist Party (CCP). They argue that despite efforts to restrict technology transfer to Huawei and SMIC, the BIS has been granting licenses worth billions of dollars.
Huawei and SMIC have not yet responded to these allegations. Both companies were added to the US trade blacklist in 2019 and 2020, respectively, due to national security concerns. Since being blacklisted, US suppliers are required to obtain special licenses to conduct business with these firms.
The recent unveiling of Huawei’s Mate 60 Pro smartphone, which utilizes an advanced 7-nanometre chip capable of supporting 5G, has raised questions about the effectiveness of the US government’s policies aimed at limiting China’s advancement in chip technology.
Republican Mike Gallagher, chair of the House committee on China, has called for a cessation of all technology exports to Huawei and SMIC. The Commerce Department acknowledged the situation and stated that they are investigating the capabilities of the new chip, emphasizing that export controls are only one aspect of the US’s strategy to address security threats from the People’s Republic of China.
