Navigating Free Trade Agreements (FTAs) within the European Union (EU) has been far from smooth sailing. The journey of the EU’s first “new generation” trade agreement with Canada has been lengthy and marked by hurdles, while the pact with Singapore required clarification from the EU Court before receiving approval.

Previous negotiations under the auspices of the European Commission yielded provisional deals with significant players such as Japan, Mexico, and the Mercosur bloc, consisting of Argentina, Brazil, Uruguay, and Paraguay.

However, the EU’s agreement with New Zealand stands out as unique, earning favor from the current Commission for its emphasis on “sustainable trade.” Notably, this agreement is the first to introduce potential sanctions for violations of environmental or labor commitments. This measure aims to address longstanding calls from European farmers for “reciprocity” in production standards.

One factor contributing to the relative ease of negotiations with New Zealand is its limited impact on the EU’s agri-food sector, despite being a top supplier of sheep and goat meat. Consequently, opposition from farmers and European governments has been muted.

Despite New Zealand’s prominence in certain sectors, its utilization of post-Brexit duty-free quotas for sheep and goat meat has been modest. The trade agreement aims to boost these figures, allowing for an additional influx of fresh and frozen lamb meat into the EU without tariffs.

However, the benefits for other agricultural products are less significant, leaving New Zealand’s livestock producers dissatisfied. For instance, quotas for beef, cheese, and milk powder fail to make a substantial impact on EU consumption.

Replicating the New Zealand model with other trading partners has proven challenging, particularly amid a global shift towards protectionism. Negotiations with Australia faltered over agricultural access demands, echoing the concerns of farming lobbies wary of concessions akin to those granted to New Zealand.

Similarly, the long-stalled EU-Mercosur trade deal faces hurdles, with opposition stemming from concerns over its impact on the European agricultural sector.

Despite these challenges, opportunities for progress remain. With the absence of Brazilian elections until 2026 and the potential cooperation of Argentina’s new leadership, the European Commission is presented with a final opportunity to finalize the Mercosur deal.

Efforts to bridge the gap between the sustainability commitments of the New Zealand and Mercosur agreements present a significant challenge for the EU in trade and agriculture.

– European Commission Extends State Aid Emergency Rules for Farmers: The EU executive announced a six-month extension of the extraordinary framework allowing member states to grant support to farms and fishermen due to “persisting” market disruptions.
– Uncertainty Looms in EU Agricultural Markets: Inflation remains a primary concern in EU agricultural markets, according to the spring 2024 edition of the European Agricultural Market Outlook of the European Commission.
– EU Executive Considers Weakening Peatland Protection Requirement for Farmers: During a meeting of Agriculture and Fisheries (AGRIFISH) ministers, a group of EU countries called for relaxing rules on mandatory practices to protect peatlands and wetlands under the EU’s Common Agricultural Policy (CAP).
– Austria Urges Delay in Implementation of EU Anti-Deforestation Law: Austrian Agriculture Minister Norbert Totschnig and Economy Minister Martin Kocher urge European Commission President Ursula von der Leyen to postpone the implementation of the EU’s new anti-deforestation regulation (EUDR), scheduled for January 2025.
– France Leads Coalition to Address UK’s Bottom Fishing Ban: France leads a coalition of member states to pressure the European Commission to impose sanctions on the UK for non-compliance with the 2020 Trade and Cooperation Agreement (TCA).
– European Commission Prepared Amid US Bird Flu Outbreak: The EU executive states it is “well prepared” in the event of a pandemic following concerns over the spread of H5NI – high pathogenic bird flu – in the United States.

These developments underscore the ongoing complexities and dynamics within the EU’s agricultural and trade landscape, highlighting the intricate balance between economic interests, regulatory frameworks, and sustainability objectives.
