The government of Uganda has expressed its concern following the United States’ decision to exclude the country from the African Growth and Opportunity Act (AGOA). This decision, announced by the US, also affects the Central African Republic, Gabon, and Niger, and will take effect in January 2024. AGOA, in place since 2000, enables African nations to export a diverse array of products to the US without duty charges. The program’s eligibility criteria include adherence to political pluralism, human rights standards, rule of law, and anti-corruption measures.
The exclusion of Uganda was prompted by allegations of human rights violations, particularly following the enactment of the “Anti-Homosexuality Act 2023.” This legislation has drawn international criticism from various human rights organizations, the United Nations, and Western countries. US President Joe Biden, in a letter to Congress, cited these concerns as the basis for the decision. Odrek Rwabwogo, a senior adviser to Ugandan President Yoweri Museveni, stated that the US decision is disappointing and could adversely affect Ugandan farmers and small businesses. He emphasized that while Uganda’s trade under AGOA might not be substantial, its growth was vital to the country’s economic strategy.
The Ugandan government remains open to dialogue with the US on this matter. The “Anti-Homosexuality Act 2023” includes severe penalties for homosexual relations and the promotion of homosexuality, with the most serious offenses attracting the death penalty, although this has not been enforced in recent years. Following the passage of this law, there were immediate international reactions, including a call from President Biden for its repeal and a warning of potential reductions in American aid and investments. Additionally, the World Bank announced a suspension of new loans to Uganda in August. The situation highlights the ongoing international debate over human rights and trade relations, and the impact of domestic policies on international economic partnerships.
