Hong Kong’s migrant domestic workers, constituting a significant workforce of around 340,000 individuals, are pushing for their rights in a bid to address long-standing issues of exploitation and abuse. Despite their crucial contributions to the local economy, these workers, predominantly from Indonesia and the Philippines, grapple with institutional obstacles, including low pay, stringent immigration rules, and the lack of welfare benefits.

Several cases have highlighted the harsh conditions faced by domestic workers, such as extended working hours, abuse, and exploitative practices by employers. In January, a significant ruling by a Hong Kong labour tribunal favored two sisters who were subjected to illegal work conditions, including a second job in their employer’s beauty salon and an inadequate monthly salary during the pandemic.

The broader challenges include the “two-week” rule, requiring domestic workers to leave Hong Kong within two weeks if unemployed, fostering fear of deportation and discouraging them from leaving abusive employers. The “live-in” laws compel them to reside in their employers’ homes, contributing to overwork and inadequate living conditions.

Critics argue that these regulations, coupled with a second-class status, make it challenging for domestic workers to assert their rights. A United Nations report in March urged Hong Kong to amend these rules, apply the minimum wage to migrant domestic workers, and address exploitative practices.

Despite the significant role played by these workers in supporting Hong Kong’s families and economy, they are often viewed as tools rather than humans. The minimum allowable wage of 4,730 Hong Kong dollars ($603) per month, while mandated by law, is less than a quarter of the city’s median monthly wage, reflecting disparities that have fueled calls for reform.

The advocacy for domestic workers’ rights involves legal battles, public information drives, and support groups. Campaigns have led to positive changes in the past, such as a ban on window cleaning and the right to attend Labour Tribunals remotely. However, challenges persist, including fees imposed by employment agencies and restrictions on changing employers.

Controversies, like the recent crackdown on “job hopping,” where workers change employers before the end of their contracts, further intensify the debate over domestic workers’ rights. The increasing demand for live-in carers in an aging society adds complexity to the issue, with projections indicating a need for 600,000 migrant domestic workers in Hong Kong by 2047.

While progress has been made, the ongoing struggles of domestic workers highlight the need for comprehensive reforms, including addressing regulatory shortcomings, enhancing legal protections, and fostering a supportive environment for these essential contributors to Hong Kong’s society and economy.
