On February 29, 2024, the European Parliament voted in favor of the EU-Kenya Economic Partnership Agreement (EPA), marking the end of two decades of negotiations. While hailed as a milestone by the European Commission, this development has stirred discontent within the East African Community (EAC) and underscored broader complexities surrounding trade agreements between African states and global economic powers.

African nations, like Kenya, find themselves regularly presented with free trade agreements (FTAs) by major global economic powers, often under terms perceived as disadvantageous. These agreements, despite claims of mutual benefit, frequently result in imbalanced power dynamics that leave African economies vulnerable. Recent events, however, have showcased instances where resistance to European and US influence has been evident, signaling a growing assertiveness in safeguarding African trade interests.

One such example is the African Growth and Opportunity Act (AGOA), initiated by the United States in 2000. AGOA’s Generalized System of Preferences (GSP) offers trade benefits to African states but has faced criticism for its conditional nature. African nations must navigate a complex web of economic and diplomatic pressures to maintain eligibility for AGOA benefits, with unilateral reassessments conducted annually by the US. The suspension of countries like Rwanda and Ethiopia in response to issues such as trade policies and human rights violations highlights the challenges African nations face in balancing their interests with external demands.

Furthermore, the US has actively promoted Trade and Investment Framework Agreements (TIFAs) as precursors to FTAs. However, concerns have been raised regarding the fairness of negotiations, with African countries facing subtle threats and incentives. While TIFAs are framed as facilitating trade relations and investment, African negotiators must navigate unequal power dynamics and safeguard their nations’ interests against potentially unfavorable terms.

Similarly, the European Union (EU) has pursued its trade interests through Economic Partnership Agreements (EPAs) with African, Caribbean, and Pacific (ACP) countries since 2002. The EU’s approach has included leveraging market access as a bargaining chip, threatening withdrawal if EPAs are not agreed upon. Additionally, promises of assistance to enhance competitiveness and tax systems have been made, although some experts view this aid as repackaged old assistance rather than genuine support for African development.

Despite efforts by the EU, negotiations for EPAs have been protracted and resulted in agreements with only a limited number of African regions and states. Some African countries have opted to retain Generalized System of Preferences (GSP) benefits regulated by the World Trade Organization (WTO) instead of signing EPAs, citing concerns over the potential loss of autonomy and economic sovereignty.

The EU’s negotiations with the Maghreb region have faced similar challenges, with countries like Morocco and Tunisia showing resistance to Deep and Comprehensive Free Trade Agreements (DCFTAs). Issues such as alignment with EU regulations and values, potential loss of national sovereignty, and economic implications have prompted cautious deliberation and, in some cases, suspension of negotiations.

Overall, African nations have demonstrated their capacity to resist unfavorable agreements and assert their interests, albeit within a framework largely determined by the US and EU. While recent developments signal a growing assertiveness in safeguarding African trade interests, there remains a disparity between the priorities of African states and the objectives pursued by external powers in trade negotiations. As African countries continue to navigate complex trade landscapes, achieving mutually beneficial agreements that prioritize sustainable development and economic sovereignty will remain a paramount challenge.
